Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of wasatchcrestgroup.com and your purchases from Wasatch Crest LLC, a Utah limited liability company doing business as Wasatch Crest (“we,” “us” or “our”). By using the site or placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

Products

Our throws, cushion covers and inserts are home textiles, and our Blanket Ladder and Throw Basket are home furnishings. Colours, pattern placement and sizes may differ slightly from what you see on screen. Our throws are not heated or weighted blankets, and nothing we sell is intended for babies, children's beds or sleep.

Prices and availability

Prices are in US dollars and may change at any time. Products are subject to availability. If a product is listed at the wrong price or with wrong information, we may cancel any order for it, even after you've received an order confirmation, and we'll refund any payment.

Orders and payment

Your order is an offer to buy. We accept it when we ship it. We may limit quantities or refuse or cancel any order, including orders that appear fraudulent. You agree to give us current, complete and accurate payment and shipping information.

Cancelling an order. To cancel, email support@wasatchcrestgroup.com or call (385) 531-8801 before your order ships, and we'll refund it in full to your original payment method. Once it has shipped, you can return it under our returns policy.

Discount codes

Discount codes can't be combined, can't be applied to sets or bundles unless the code says so, and have no cash value.

Shipping and risk of loss

We ship only to the destinations described in our Shipping and Returns policy. Risk of loss passes to you on delivery. If an order arrives damaged, follow the steps in our Shipping and Returns policy.

Returns

Returns and refunds are governed by our Shipping and Returns policy, which is part of these Terms.

Using our products

Read and follow the directions and warnings that come with every product. Never use a throw, cushion or insert in a crib or a child's bed. Keep throws and cushions away from open flames and space heaters. The Blanket Ladder is for hanging throws only: lean it against a wall on a level floor, keep it out of walkways, and never climb or stand on it.

Intellectual property

The site and everything on it, including the Wasatch Crest name, logo, patterns, product names, text and images, belong to us or our licensors. You may not copy or use them without our written permission.

Reviews and comments

If you send us a review, comment or idea, you give us a non-exclusive, royalty-free right to use, reproduce and display it in connection with our business. You agree that it is truthful and that it doesn't violate anyone's rights. We don't edit reviews to change their meaning.

Use of the site

Don't use the site for any unlawful purpose, interfere with its operation, try to gain unauthorized access to it, or use automated tools to collect information from it.

Disclaimer

To the fullest extent permitted by law, the site and our products are provided “as is” and “as available,” and we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our products. Our total liability for any claim is limited to the amount you paid for the product that gave rise to the claim.

Indemnification

You agree to indemnify and hold harmless Wasatch Crest LLC and its owners, employees and agents from any claim arising out of your misuse of our products or the site, or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah County, Utah, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. The version posted on the site when you place an order applies to that order.

General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Shipping and Returns policy and Privacy Policy, are the entire agreement between you and us about the site and your purchases.
